This Privacy Policy (“Privacy Policy” or “Policy”) explains how Saltair (The Center Brands LLC d/b/a Saltair) (“Saltair,” or “we,” or “us,” or “our”) collects, uses, and shares personal information in connection with your interactions with us online, including on our website, all subdomains, our social media pages that link to this Privacy Policy, our marketing activities, and our e-commerce activities (the “Services”). This Policy also describes rights you may have with respect to your personal information.
This Privacy Policy is incorporated into, and is part of, our Terms of Use, which governs your access to and your use of the Services. By accessing our Services or otherwise interacting with us, you agree to the terms of our Terms of Use, including this Policy. If you do not agree to the terms of this Privacy Policy, please do not use the Services or provide us with your personal information. Each time you use the Services, the current version of this Privacy Policy will apply. Accordingly, when you use the Services, you should check the date of this Privacy Policy (which appears at the top) and review any changes since you last reviewed the Privacy Policy.
This Policy does not cover the personal information we collect about employees and independent contractors, or job applicants.
We collect two types of information: “personal information,” which is information that can be used to identify you (such as your name, address, email address, or business contact details), and “aggregate information,” which is information that cannot be used to identify you (such as frequency of visits to our website and your browser type).
Personal Information We Collect
We collect the following categories of personal information:
- Personal identifiers: name (first and last), email address, your home, shipping or billing address, telephone numbers (including mobile number for SMS), customer number, account name and password, social/community handles (e.g., Discord ID, TikTok handle, creator ID) for influencer or affiliate participants, information related to customer reviews, IP address, and unique device identifiers
- Commercial and financial information: records of products ordered or considered; other purchasing or consuming histories; returns, exchanges and refund records; loyalty/VIP segmentation tags; and payment information
- Internet or other electronic activity information: your device, operating system and browser type and version, your browsing and search history on our website, pages visited, time and date of visits, time spent per page, session and diagnostic data, UTM and other campaign attribution parameters, email and SMS engagement events (e.g., opens, clicks, last active), and information regarding your interaction with our website, our messages, and our advertisements
- Geolocation information: approximate location derived from IP address, shipping/billing address, and locale settings, used for shipping, regional analytics, fraud prevention, and content localization
- Demographic information: optional information you may provide in connection with reviews or creator/influencer programs, such as age or age range, sex/gender, body type, and fashion style
- User-generated content: product reviews, ratings, recommendations, photos, screenshots, video, and other content you submit, together with associated reviewer nickname or username
- Marketing and communications preferences: your email and SMS marketing opt-in and opt-out records, the date, source and method of consent, and other compliance records
- Customer service communications: the contents of inquiries, support tickets, chat messages and related correspondence with our customer service team
- Adverse reaction and product safety information: if you report an adverse reaction or other experience with one of our products, we may collect information about the reaction or experience (including symptoms, severity and duration), the product(s) involved, usage details, and any related health information you choose to provide
- Inferences and predictive data: inferences and predictive scores derived from your activity, such as predicted or historic customer lifetime value, engagement and segmentation scores, and attribution data
We have collected the same categories of personal information in the 12 months prior to the date of this Privacy Policy.
Purposes for Collection of Personal Information
We collect your personal information to provide our products to you and fulfill customer orders; to process returns, exchanges and refunds; to manage your account; to send order confirmations, shipping updates and other transactional communications by email and SMS; to contact you from time to time; to provide you with information about our business; for customer support; to deliver advertisements and marketing promotions and offers (including email and SMS marketing where you have opted in) about products we think may be of interest to you; to operate our customer review, user-generated content and creator/influencer/affiliate programs; to respond to your inquiries; to customize your experience and personalize content; to perform attribution, segmentation, predictive analytics and lifetime-value modeling; to monitor the safety and quality of our products by collecting, evaluating and following up on adverse reactions and other product experiences; and to audit and analyze the placement and effectiveness of our advertisements and other marketing efforts.
We also use personal information to monitor or improve our website; for internal business analysis; to prevent fraud, activities that violate our Terms of Service or other contracts, or that are illegal; and to protect our rights and the rights and safety of our users or others.
For those who interact with us in a commercial capacity, we use your personal information to engage in business transactions with the entity you represent and market to or engage in diligence with the entities you represent.
Categories of Personal Information We Sell or Share and Related Information
When we engage in digital advertising, we may sell the following categories of personal information (according to the broad definition of “sell” under select state privacy laws) or we may share them for purposes of cross-context behavioral advertising: personal identifiers (including name, email address, telephone number, IP address and unique device identifiers); internet or other electronic activity information (including pages visited, session and campaign attribution data, and email and SMS engagement events); and approximate geolocation derived from IP address.
These categories of personal information are sold to or shared for cross-context behavioral advertising to advertising networks and other companies that facilitate digital advertising, including Meta (Facebook and Instagram), Google (including YouTube), TikTok, Pinterest and Snapchat. We engage in such sales and sharing to facilitate digital advertising that is able to reach people that are most likely to be interested in the Services we provide. We do so by allowing third parties to place cookies or other tracking technologies on our website that may collect information about your online activities over time and across different websites or applications. We do not sell or share for cross-context behavioral advertising any of the other categories of personal information we collect.
Retention Periods
We retain the categories of personal information we collect for the length of time necessary to provide our Services (including any warranty, returns or support services) and to comply with legal obligations or to protect our legal rights. Retention periods vary by category and platform. By way of example, customer account and order data is generally retained for the duration of your account plus three (3) years after your last purchase; financial and tax records are retained for seven (7) years; email marketing profiles are retained while active and for up to two (2) years after suppression; SMS subscriber data is deleted within thirty (30) days of opt-out, and the related consent records are retained for five (5) years; customer support tickets are retained for three (3) years following ticket closure; reviews and user-generated content are retained for the duration the content is live (and, in some cases, for up to three (3) years thereafter); and website session, device and diagnostic data is generally retained for between thirty (30) and one hundred eighty (180) days.
Sources From Which We Collect Personal Information
We collect personal information directly from our customers, website users, SMS and email subscribers, reviewers, creators/influencers/affiliates, and representatives of entities with which we do business or may do business. We also collect personal information automatically through your interactions with our website, mobile experiences, marketing emails and SMS messages, and through cookies and similar tracking technologies (including via affiliate links).
In addition, we receive personal information from our service providers and integration partners, including our e-commerce platform (Shopify), as well as our email marketing, SMS marketing, customer review, customer service, returns, data warehouse and analytics, business intelligence, ERP, affiliate marketing and creator, attribution, and advertising and analytics partners.
Use or Disclosure of Sensitive Personal Information
Sensitive Personal Information. Certain US state privacy laws define a subset of personal information as “sensitive personal information” or “sensitive data.” We do not generally knowingly collect sensitive personal information except in limited contexts and for limited purposes. We collect account log-in credentials (account name and password) solely as needed to authenticate you and provide access to your account, and we do not use or disclose those credentials for any other purpose. To the extent we process any other sensitive personal information (for example, payment account information solely as needed to process a transaction), we do so only for purposes permitted by applicable law and we do not use or disclose such information to infer characteristics about you, to create profiles, or for any purpose other than providing our Services. Where you voluntarily provide demographic information (such as age or age range, sex/gender, body type or fashion style) in connection with submitting a review or participating in a creator program, we use that information for the limited purposes of fit and sizing insights, review filtering and display, age-gating and creator eligibility, and related analytics, and we do not sell or share such information for cross-context behavioral advertising. If you report an adverse reaction to one of our products, we may collect health-related information you choose to provide. We use such information solely for internal product safety and quality monitoring purposes and as required or permitted by law (including to comply with regulatory reporting obligations), and we do not sell or share adverse reaction information for cross-context behavioral advertising or for any other commercial purpose.

Additional Information About How We May Disclose Personal Information and Purposes for Disclosures
We may also share your personal information as required or permitted by law to comply with a subpoena or similar legal process or government request, or when we believe in good faith that disclosure is legally required or otherwise necessary to protect our rights and property or the rights, property or safety of others, including to law enforcement agencies, and judicial and regulatory authorities. Where required by law, we may report adverse reaction information to the U.S. Food and Drug Administration or other regulatory authorities. We may also share your personal information with third parties to help detect and protect against fraud or data security vulnerabilities. And we may share or transfer your personal information to a third party in the event of an actual or potential sale, merger, reorganization of our entity or other restructuring.
Our Use of Cookies and Analytics
We may use cookies, pixel tags, web beacons and other similar tracking technologies (“tracking technologies”) to automatically collect information through our website. Tracking technologies are essentially small data files placed on your computer, tablet, mobile phone, or other devices that record certain pieces of information when you visit our website. We may use these tracking technologies to help identify irregular behavior, prevent fraudulent activity and improve security, as well as making it possible for you to save your preferences and help us understand how you interact with our website.
We also allow third parties to use tracking technologies on our website for analytics and advertising. The following third-party pixels and tags are currently installed on our website: Attentive (SMS marketing), AWIN (affiliate marketing), Bazaarvoice (ratings and reviews), Meta (Facebook and Instagram), Google and YouTube, Klaviyo (email marketing), Pinterest, Snapchat, TikTok, and WorkMagic (attribution). These third parties assist in displaying advertisements, tailoring advertisements to your interests and determining if you require assistance or are having problems navigating on our website. Some of these third parties use tracking technologies to collect information about how you interact with other websites and advertisements across the Internet in order to provide advertising that is tailored to your interests and which may appear on our website or on other websites or platforms.
You may set your browser to notify you when you receive a cookie. Many web browsers also allow you to block cookies. You can disable cookies from your computer system by following the instructions on your browser or at www.youradchoices.com. You may also manage your cookie preferences through the "Cookie Settings" link in the footer of our website.
We use analytics tools, including those provided by third-parties such as Google Analytics, to evaluate the use of our website and measure performance of our marketing efforts. Google Analytics uses cookies and other identifiers to collect information, such as how often users visit a site, what pages they visit when they do so, and what other websites they visited prior to visiting our site. Other third-party analytics providers receive customer and behavioral data to provide analytics and marketing attribution insights.
Aggregate Information Collected
Aggregate information is information that does not identify you. Aggregate information may be collected when you use our Services, independent of any information you voluntarily enter. Additionally, we may use one or more processes to de-identify information that contains personal information such that only aggregate information remains. We may collect, use, store, and transfer aggregate information without restriction.
SMS/Text Message Marketing Program
If you sign up for our text message marketing program, the collection and use of your information in connection with that program is also governed by our Messaging Privacy Policy, as may be amended from time to time. The Messaging Privacy Policy explains how we collect and use information specifically related to our text message marketing service provided through Attentive, including information about message types, frequency, opt-out instructions, and how to contact customer care. In the event of any conflict between this Privacy Policy and the Messaging Privacy Policy with respect to our text message marketing program, the Messaging Privacy Policy will control.
Personal Information of Children and Minors
Our products and website are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13 or sell or share for purposes of cross-context behavioral advertising the personal information of children under 13. Consistent with applicable state privacy laws, we do not knowingly sell or share for purposes of cross-context behavioral advertising the personal information of consumers we know to be at least 13 and less than 16 years of age unless we obtain affirmative authorization (“opt-in consent”) from the consumer. We do not knowingly process the personal data of a consumer we know to be at least 13 and less than 16 years of age for purposes of targeted advertising, sale or profiling in furtherance of decisions that produce legal or similarly significant effects, except with consent. Do Not Track Signals
Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. There is currently no industry-accepted standard for responding to DNT signals, and we do not respond to or honor DNT signals. We do, however, recognize and process opt-out preference signals (such as the Global Privacy Control) sent by a platform, technology or mechanism that we are required to recognize under applicable law as a request to opt out of the sale of personal information and/or the sharing or processing of personal information for purposes of targeted (cross-context behavioral) advertising for the browser or device from which the signal is sent.
How We Keep Your Personal Information Secure
We implement and maintain reasonable security controls designed to protect the personal information that we collect and process. Despite our safeguards, we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your personal information.
Changes to This Policy
We will review and update this Policy from time to time. If changes are made, we will update the Privacy Policy and reflect the date of such modification in the date above. Where required by applicable law, we will provide notice to you of any material changes.

US State Data Privacy Rights
Laws in certain U.S. states give residents of those states specific rights with respect to the personal information we collect about them. The rights described below are subject to the conditions, exceptions and thresholds set forth in the applicable state law, and the rights available to you depend on the state in which you reside. Where a right is provided only in certain states, that is noted.
Your Rights
Right to Know and Access. You have the right to confirm whether we are processing your personal information and to request the following information about the personal information we have collected about you (in California, generally for the 12 months prior to our receipt of your request, and in other states for the period required by applicable law):
- Specific pieces of personal information we have collected about you;
- Categories of personal information we have collected about you;
- Categories of sources from which such personal information was collected;
- Categories of personal information that the business sold or disclosed for a business purpose about the consumer;
- Categories of third parties to whom the personal information was sold or disclosed for a business purpose; and
- The business or commercial purpose for collecting or selling your personal information.
Right to Delete. Subject to exceptions in applicable law, you have the right to request that we delete the personal information we have collected from you (and, in some states, personal information we have obtained about you). Right to Correct. You have the right to request that we correct personal information we hold that you believe is not accurate. We will take steps to determine the accuracy of the personal information that is the subject of your request to correct, and in doing so will consider the totality of the circumstances relating to the personal information you have identified as being incorrect. We may ask that you provide documentation regarding your request to correct in order to assist us in evaluating the request. Right to Opt Out of Sale, Sharing and Targeted Advertising. With respect to those categories of personal information that we sell to third parties or share with third parties for the purpose of cross-context behavioral advertising, you have the right to opt out of such sales and sharing. You can do so through this link or by emailing info@saltair.com. You may also exercise this right by enabling an opt-out preference signal (such as the Global Privacy Control) in a supported browser or device, and we will treat such signal as a valid request to opt out of the sale of personal information and/or sharing of personal information for purposes of cross-context behavioral advertising for that browser or device.
Right to Limit the Use and Disclosure of Sensitive Personal Information / Sensitive Data Consent. If we use or disclose sensitive personal information for purposes other than those permitted by applicable law (e.g., for purposes other than to perform the services or provide the goods reasonably expected by an average consumer who requests them), you have the right to direct us to limit such use and disclosure. As described above, we do not currently use or disclose sensitive personal information for purposes that would trigger this right. If our practices change, we will update this Policy and provide a method for you to exercise these rights.
Right to Data Portability. You have the right to request that the personal information you have provided to us be transmitted to you in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the information to another entity without hindrance. Right to Non-Discrimination and Non-Retaliation. If you exercise any of the rights explained in this Privacy Policy, we will continue to treat you fairly. If you exercise your rights under this Privacy Policy, you will not be denied or charged different prices or rates for goods or services, or provided a different level or quality of goods or services than others.
How to Exercise Your Rights and How We Will Respond. To exercise your rights to know/access, delete, correct or port your personal information, visit this link or contact us at info@saltair.com. We will acknowledge receipt of your request as required by applicable law and will provide a substantive response as soon as we can, generally within 45 days from when we receive your request, although we may extend our response time as permitted by applicable law and will let you know if an extension is needed.
You can direct us not to sell your personal information or share it for purposes of cross-context behavioral advertising via the Do Not Sell / Share My Information link in the footer of the site. For such requests, we will comply no later than 15 business days after receipt of your request.
We usually act on requests and provide information free of charge, but we may charge a reasonable fee to cover our administrative costs of providing the information in certain situations. In some cases, the law may allow us to refuse to act on certain requests. When this is the case, we will endeavor to provide you with an explanation as to why.
Verification of Identity. We will ask you for two pieces of personal information and attempt to match those to information that we maintain about you.
If we are unable to verify your identity with the degree of certainty required, we will not be able to respond to the request. We will notify you to explain the basis of the denial.
Authorized Agents. You may designate an authorized agent to submit requests on your behalf. The agent can be a natural person or a business entity. Residents of certain states may also designate an authorized agent to submit opt-out requests (including via opt-out preference signals such as the Global Privacy Control) on their behalf.
If you would like to designate an agent to act on your behalf, you and the agent will need to comply with our verification process:
- Requests to Know, Delete or Correct Personal Information: If the agent submits a request, the agent will need to provide us with your signed permission indicating the agent has been authorized to submit the request on your behalf. We will also require that you verify your identity directly with us or confirm with us that you provided the agent with permission to submit the request.
- Requests to Opt Out of Sale or Sharing: If the agent submits a request to opt out of the sale of your personal information or the sharing of your personal information for purposes of cross-context behavioral marketing, the agent will need to provide us with your signed permission indicating the agent has been authorized to submit the opt-out request on your behalf (unless the request is made via opt-out preference signals such as the Global Privacy Control).

Any such requests will be processed in accordance with applicable state law pertaining to powers of attorney.
Notice of Financial Incentives. We offer financial incentives, including coupons, discounts, and other benefits to you for sharing your personal information with us, including, but not limited to, when you sign up for promotional marketing communications. We may ask you to provide your contact information (such as email address or phone number) and additional categories of personal information requested at the time you opt in to participate. We will use your personal information as described in the section above, "Purposes for Collection of Personal Information." In order to participate, you will opt in by following the instructions provided. In some cases, you may be subject to additional terms and conditions, which we will provide to you at enrollment. You may opt out at any time. For promotional marketing, you may unsubscribe by following the unsubscribe or opt out instructions in our promotional messages. The value of your personal information is reasonably related to the value of the offer or discount presented to you. We estimate the value of personal information considering factors such as expenses in the administration of the offering. The value to us depends on the benefits offered to you in the financial incentive. We may offer financial or non-financial incentives in connection with programs that require you to disclose certain personal information, but only if you opt in to such an incentive program. If you ask us to delete your personal information or opt out of the use of your information, we will comply with your request. However, because your contact information may be necessary for us to deliver coupons and financial incentives, and to send you marketing communications, deletion of your contact information will result in removal from the marketing list and forfeiture of any financial incentives related to the program. This is because we cannot deliver text-message and email-based benefits without retaining your contact information.
Automated Decision-Making and Profiling. We use certain automated tools (including machine learning models maintained by our service providers) for purposes such as audience segmentation, predicting customer lifetime value, fraud prevention, and measuring marketing engagement and attribution. We do not use automated decision-making or profiling to make decisions that produce legal or similarly significant effects concerning you. Right to Appeal. If we decline to take action on a privacy rights request you submit under a state privacy law that provides an appeal right, you may appeal our decision within a reasonable period of time after receipt of our decision by emailing info@saltair.com with the subject line “Privacy Rights Appeal” and including a copy of our denial. Within 60 days (or such other period required by applicable state law), we will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If your appeal is denied, you may contact your state attorney general to submit a complaint.
State-Specific Provisions
Certain states impose additional disclosures or provide rights that are particular to that state. Those state-specific provisions are set forth below.
Right to a List of Third-Party Recipients. Residents of certain states have the right to obtain a list of the categories of third parties to which we have disclosed personal information (and, in some states, the specific third parties). You can make a request by emailing info@saltair.com.
California Shine the Light. California Civil Code Section 1798.83, also known as the “Shine the Light” law, permits California residents to annually request, free of charge, information about the personal information (if any) disclosed to third parties for direct marketing purposes in the preceding calendar year. State-Specific Rights Limitations. Some of the rights described above do not apply in every state, or are subject to additional conditions, exceptions or thresholds under the applicable state law.
Nevada Sale of Personal Information. Nevada law provides Nevada residents with the right to opt out of the sale of certain personal information. We do not currently sell covered information about Nevada residents as defined under Nevada law. To submit an opt-out request, please email info@saltair.com.
